True Case.
The defendant, tired of her philandering husband beating her and abusing her 3 children decides to physically confront him. Although she was much smaller, she won the confrontation. The husband, his ego and body bruised, decides to call the police. The police see the bruises, ask no questions, do no investigation and arrest the wife. She spends the weekend in jail, an unfamiliar setting to a married mother of three with a college degree and teaching credential. At her arraignment the free attorney tells her to plead guilty to get out of jail. She takes his advice, is restrained from returning home and is ordered to pay hundreds of dollars in fines and attend 52 weeks of domestic violence class payable out of her own pocket. She loses her job at the school because of the criminal conviction and the children are taken away by the Dependency Court and placed with family member because of the child abuse she "allowed the husband to commit against the children.To make matters worse, she finds out that her husband's new 22 year old girlfriend moved into her house and is having a yard sale selling her personal belongings. She tries to go back to criminal court to withdraw her plea of guilty, but the request falls upon deaf ears. The Dependency Court allowed her to have 'monitored' visits with her children while she rented a room in a local apartment. After over a year of classes and court appearances in criminal court, dependency court and divorce court, she finally has her children back with her in her house.
Tragically, this could've all been avoided had she had an aggressive and caring attorney with her at her 1st court appearance.
