Many people wrongfully assume that corporal punishment can no longer be used to discipline a child. 

In order to prove that you are guilty of the crime of child abuse, the Prosecutor must prove (beyond a reasonable doubt) that:

1) You willfully inflicted unjustifiable physical pain or mental suffering on a child;

OR

1) You, while having care or custody of a child, willfully caused or permitted the child's person or health to be injured;

OR

1) You, while having care or custody of a child, willfully caused or permitted the child to be placed in a stituation where the child's person or health was endangered;

AND

2) You were criminally negligent when you caused or permitted the child to suffer/or be injured/or be endangered/

AND

2) You did not act while REASONABLY disciplining a child.

*Someone commits an act willfully when he or she does it willingly or on purpose.

A child is any person under the age of 18 years.

Unjustifiable physical pain or mental suffering is pain or suffering that is not reasonably necessary or is excessive under the circumstances.
