Protective Orders and Restraining Orders
Protective orders and restraining orders are very common in domestic violence cases. An emergency protective order also known as an "EPO" can be obtained immediately and can last up to (7) seven days. It may include a number of orders including a stay away or move out order and even temporary child custody orders.
Temporary restraining orders may also be granted and are valid until a ruling is made on your next court date. If the judge or judicial magistrate decides to continue the order, it may last for years. If you violate a restraining order or EPO, you can be arrested and found in contempt of the restraining order or, the prosecutor can file misdemeanor charges against you. Penalties include up to a year in jail and a $1,000 fine.
